ZBA-Tues., Jan. 10, 2012 @ 7 pm on agenda: Deck Extends into Lake

Hi All,
The Township finally posted the ZBA agenda for Tuesday, Jan. 10, 2012.
The law says it shall be posted 15 days in advance.  I "think" the Township posts in the Eccentric, but why not on their website? The Township also posts on the bulletin board in the lobby of Township Hall. How many of the 41,000 residents will see those notices?

The Township website has a LEGAL NOTICES section as well as a ZBA agenda section.  This agenda was not there 15 days in advance.  As of this writing, still not in the legal notices section. Why? The website should be used to communicate to the residents.

Is Your Neighborhood Affected?
Below is the short agenda for Tuesday's ZBA meeting.  However, please check to see if anything is in your neighborhood or pass this information to those you know who may be affected.  Check out the address for the deck extending into the lake.  How do the other lake owners feel about this request?
A commercial zoning request is about a wall sign size.  Requesting much larger than permitted.

ZBA decisions are final unless contested in court.  Be informed. Make comments before the decision.

B. New Items

1)
Seeking approval for existing fencing enclosing a portion of the northerly side yard and the tennis court area, to be utilized for dog containment, set back 16 ft. from the northerly side property line and less than 25 ft. from the rear property line, Section 30, Sly Farms No. 1, Lot 32 and part of Lot 33. The Code of the Charter Township of Bloomfield, Section 8, Article II, Section 8-26 states that dog enclosures must be located in a rear yard and set back a minimum of sixteen (16) ft. from a side lot line and twenty-five (25) ft. from a rear lot line, and shall require the review and approval of the Zoning Board of Appeals.

Seeking approval for a proposed 30 ft. wide by 13 ft. deep sandy beach area at the water’s edge, encroaching into the required 25 ft. natural features setback, Section 8, Indianwood Subdivision, Lot 2. The Code of the Charter Township of Bloomfield, Section 42-5.13, requires a 25 ft. setback from a natural feature.

Seeking approval for a proposed accessory structure, a 44 ft. by 35 ft. 7 in. by 7.5 ft. high free-standing deck at the water’s edge, encroaching into the required 25 ft. natural features setback, Section 31, Meadowlake Farms, Lot 116, with an additional portion of the deck extending into the water. The Code of the Charter Township of Bloomfield, Section 42-5.1 states that accessory structures shall not be erected in any yard, except a rear yard, shall not exceed fourteen (14) feet in height, shall not be located closer than sixteen (16) feet to any side or rear lot lines, shall be screened from adjacent residences with evergreen and deciduous material which will obscure view twelve (12) months of the year, that such vegetation shall be maintained in a healthy condition, and shall require the review and approval of the Zoning Board of Appeals. The Code of the Charter Township of Bloomfield, Section 42-5.13, requires a 25 ft. setback from a natural feature.

Seeking approval for a proposed 94.5 sq. ft. internally illuminated wall sign with a proposed 63.6 sq. ft. logo, with a 4.7 sq. ft. logo allowed, resulting in a logo that is 64 percent of the overall size of the wall sign for the Ulta Beauty store located within the Bloomfield Town Square Shopping Center, Section 5, Acreage Parcel. The Code of the Charter Township of Bloomfield, Section 42-5.9, allows for one sign, wall or ground, within the B-2, General Business zone district, not to exceed six (6) percent of the total area of the street side façade, maximum size of sign not to exceed one hundred fifty (150) sq. ft., with a logo not to exceed five (5) percent of the total area of the wall sign.
